The Court of Appeal in Abuja has dismissed an appeal by Assistant Commissioner of Police, Sunday Ubua wherein he sought to be admitted to bail.

Ubua is an associate of suspended Deputy Commissioner of Police Abba Kyari, and the two are being investigated by the National Drug Law Enforcement Agency for illegal drug trafficking and other offenses.

In a decision released on Friday, a three-member panel of the appellate court determined that Ubua’s appeal lacked substance and upheld Justice Nwite’s March 28, 2022 decision.

The March 28 judgement rejected Ubua’s application for bail on the grounds that the prosecution placed sufficient materials before the court to warrant its rejection of the bail application.

Justice Stephen Adah, in the lead judgment, held that the appellant did not present any new materials before the court to warrant the court’s departure from the earlier decision on the issue by Justice Emeka Nwite of the Federal High Court, Abuja.

On charges of illegal drug dealing and attempting to tamper with evidence, Ubua is on trial with Kyari and three other former members of the Nigeria Police Force’s Intelligence Response Unit, Force Investigation, and Intelligence Department.
